JK Cabinet approves ordinance allowing death penalty to child rapists

Srinagar: The ordinance which will allow courts to pronounce death penalty to child rapists was approved by the Jmamu and Kashmir cabinet on Tuesday.

Reports said that the Criminal law ordinance 2018 (amendment) and Jammu Kashmir Protection of Children from Sexual Violence were approved by the cabinet which met today in Jammu.

The ordinance would be at par with the Government of India’s law on death to accused found guilty of raping a victim up to twelve years of age. Those guilty of raping a victim, aged between 13 and 16, will get lifer.

Moreover, the ordinance also includes that the investigations in rape and sexual assault case are to be conducted by women police officers. The investigation should be completed in two months and trial by court will be complete in six months (not beyond that). The trials held will be in-camera and the bail provision will be tough.

Moreover, fines, if any will be given to the victim instead of going to the state treasury.
