Couples marrying against parents’ wishes can’t seek police protection without real threat: Allahabad HC

Prayagraj: The Allahabad High Court has ruled that couples who marry without their parents’ consent cannot claim police protection as a matter of right unless there is a genuine threat to their life or liberty.

Justice Saurabh Srivastava made the observation while hearing a writ petition filed by Shreya Kesarwani and her husband, who sought protection from interference by their families in their married life.

After reviewing the petition, the court found no evidence suggesting any real danger to the couple. Referring to the Supreme Court’s verdict in Lata Singh vs. State of UP, the judge noted that courts are not obliged to grant protection to couples who marry of their own free will in the absence of a threat.

“In the absence of any threat perception, such couples must learn to support each other and face society,” the court stated, adding that there was no indication the families posed a risk of physical or mental harm.

The court also noted that the couple had not filed a formal police complaint against any relative, although they had sent a representation to the Superintendent of Police in Chitrakoot. The court said police may take appropriate action if a credible threat emerges during their inquiry.

The petition was ultimately dismissed, with the court reiterating that protection cannot be demanded as a matter of routine or right, but may be considered in deserving cases.
