SC to hear fresh petition challenging Article 35-A today

The Supreme Court will hear a fresh petition challenging Article 35-A of the Constitution while the previous bunch of petitions challenging the legislation have been pushed for hearing on August 31.

“It is a fresh petition coming up for hearing for admission. The bunch of petitions challenging Article 35A is likely to be listed for hearing on August 31,”Jammu and Kashmir government counsel, Shoeb Alam, in the Supreme Court told Greater Kashmir.

Sources said that the top court is likely to include the petition in the bunch that would come up for hearing on August 31.

Reports said the fresh petition has been filed by Ashwani Upadhyay seeking scrapping of Article 35-A, which bars outsiders from buying immovable property in the state.

Earlier, resistance leaders called for a shutdown on August 30 and 31 to protest against the onslaught on the Article. Hurriyat (M) chairman Mirwaiz Umar Farooq said the people of Kashmir are ‘mentally and physically’ ready to defend the Article 35-A. He warned that a mass agitation would be launched “forthwith” in case of an “adverse” ruling from the Supreme Court.

Mirwaiz added that every person has to play his role and be ready to defend their “very existence.”
