Delhi High Court rejects Arnab Goswami’s petition seeking quashing of FIR against him

Republic TV’s controversial anchor Arnab Goswami has had to face another round of setback after the Delhi High Court on Wednesday rejected his petition seeking the quashing of an order by a local court, which had directed the Delhi Police to file an FIR against him, reported Janta Ka Reporter.

Rejecting Goswami’s pleas, according to Livelaw website, Justice Najmi Waziri said that the high court was not the correct forum and he should seek remedy at a sessions court.

In the High Court, Congress MP Shashi Tharoor was being represented by Vikas Pahwa and Gaurav Gupta, who argued that Goswami’s plea was not maintainable.

Metropolitan judge Dharmendra Singh of the Patiala House Court had passed an order on 21 January, directing the Delhi Police to initiate a probe and file and FIR against Goswami, for stealing confidential documents related to probe in the death of Sunanda Pushkar, wife of Congress MP Shashi Tharoor and the alleged hacking of his e-mail account.

The order had stated, “This court is of the considered view that in view of allegations leveled by complainant and material produced on record in the form of RTI replies and other material, matter disclosed commission of cognizable offence.”

Tharoor’s lawyers, Muhammad Ali Khan, Vikas Pahwa and Gaurav Gupta, had told the court that Goswami accessed confidential documents related to the probe in the death of his wife Sunanda Pushkar through illegal means.

Tharoor had also highlighted that those documents related to death of his wife were not available in public domain. This was confirmed in RTI replies. One RTI reply by the Delhi Police had said that sharing details of the probe with the public or media was simply not permissible until the investigation was over.

The current setback for Goswami comes just days after a Chief Judicial Magistrate in Jammu and Kashmir issued a non-bailable warrant against the controversial anchor, who founded Republic TV with the help of BJP’s Rajya Sabha MP, Rajeev Chandrasekhar in 2017.
