‘Undemocratic and Unconstitutional’: GoI’s August 5 decision continued to haunt me, says Mehbooba Mufti

‘We should vow to fight for our rights that were snatched last year’

Srinagar: After her 14-month-long detention under PSA, the former Chief Minister and Peoples Democratic Party (PDP) president Mehbooba Mufti on Tuesday termed August 05, 2019 decision by the government of India as undemocratic and unconstitutional and said that the decisions continued to haunt her during the detention period.

Mehbooba Mufti soon after her PSA was revoked, in a one minute and 23-second long video message, said: “I believe that people across JK are also going through the same situation.”

“Nobody amongst us can forget the day when everything was snatched from us,” she said, adding that “we should vow to fight for our rights that were snatched undemocratically and unconstitutionally by the government of India on August 05, 2019. We should also continue our struggle for the Kashmir cause that has so far claimed thousands of lives.”

She said, “I know the path is not easy but I believe that our resolve will help us in achieving the goal.”

She further said that as she has been released today, she would want all those who are under detention in different jails should be released as well.

Mehbooba has been in detention since August 5, 2019, when GoI stripped JK of its semi-autonomous status, revoked its statehood and split the erstwhile state into two Union Territories.

She has been in custody for seven months, which was set to expire in February 2020 but a new detention order was passed under PSA.

In 2019, Mufti’s was detained under Section 107 of the Code of Criminal Procedure (CrPC), which empowers an executive magistrate to order a person to execute bonds “for keeping the peace”.
