It’s nearly impossible for Pakistani prisoners to get out of Indian jails

On the day of Christmas, Pakistan released 220 Indian fishermen as a ‘goodwill gesture’. They were held for trespassing into Pakistan’s territorial waters, a Pakistani official said. The fishermen from both sides often languish in jail because of little knowledge about the maritime boundary between the two nations and end up trespassing. Amidst this friendly diplomatic move, it’s important to note that there are still many prisoners (civil and fishermen) who couldn’t be the part of this good-will gesture.

A group called ‘Aaghaz-e-dosti’, which works on several campaigns on maintaining good relations between India and Pakistan, got the latest list of Indian and Pakistani prisoners held in Pakistan and India.

In a list that is updated till 01 July 2015, that total 48 Indian prisoners (civil) were found in Pakistani jails. 29 prisoners (including 5 women prisoners) have already completed the sentence awarded to them but are unable to come back due to their nationality not being confirmed by India. A total of 13 prisoners have completed their sentence between the period of 2002 to 2010 and are unable to return due to their nationality issue. List also includes 1 prisoner who is deaf and dumb.

Long punishment (of more than 5 years and up to 25 years) awarded in only 10 cases, while for all others, punishment is within 2 years. Long punishments were awarded under Pakistan Army act and Officials Secrets Act. Here is the list of Indian prisoners confined in Pakistani jails as on 30 June, 2015.

Out of 30 prisoners who have completed their sentence, only 5 prisoners were able to get confirmation on their nationalities, 28 are still unconfirmed. One prisoner has been given death sentence by the court whereas one person’s nationality has been identified as Indian held Kashmiri.

Among the 251 total Pakistani civilians held in Indian jails, 102 are still under trial while 55 (including 1 deaf and dumb and 1 woman) have already completed their sentence but unable to return because their nationality hasn’t been confirmed yet. Here is the list of Pakistani prisoners lodged in Indian jails and detention centers.

State of sentence

Also, there are 8 prisoners whose offence hasn’t been registered yet. 137 prisoners are undergoing their sentence where as 7 prisoners have been acquitted but the nationalities of these 7 prisoners are still pending.

Prison cells

It’s important to note that 4 Pakistani prisoners are held in mental hospitals in the different parts of Gujarat – two in Ahmedabad and two in Bhuj. 28 prisoners are held in District jails whereas 60 prisoners are undergoing their sentence in central prisons in Nashik, Mumbai, Amritsar, Ferozpur, Srinagar and Cehrapalli, Telangana.

Besides civil prisoners, many fishermen have also been caught from both sides. You can check the list of Pakistani fishermen caught in India here and Indian fishermen caught in Pakistan here.
