JK HC upholds detention of ‘Dukhtaran-e-Milat affiliate’ Haseena Akhter

Srinagar: The Jammu and Kashmir High Court has maintained a preventive detention decree issued against Haseena Akhter, who is accused of having connections with the banned group Dukhtaran-e-Milat.

Justice M.A Chowdhary supported the decision for detention after determining that Haseena Akhter had been engaged in activities against the nation since her early years. Her actions were deemed to have the potential to endanger the state’s security. This ruling justified her being held in custody under the Public Safety Act.

“Having glance of the grounds of detention, it is clear that right from the tender age of the detenue she was involved in anti-national activities. Her affiliation with different banned organizations like ‘Dukhtaran-e- Milat’, Hizbul Mujahideen, Tehreek-ul-Mujahideen and Lashkar-e-Toiba, was a big threat to the security of the State. Detenue has not only been found to provide logistic support to the terrorists, but weapons/ammunition was also recovered from her possession. Moreover, she was found involved in lobbing petrol bomb upon a CRPF bunker at Sopore,” LiveLaw quoted the judge as saying.

Haseena Akhter had taken her case to the Court to contest the detainment directive issued by the Baramulla District Magistrate on April 7, 2022, under Section 8 of the Jammu and Kashmir Public Safety Act of 1978. The grounds for her detention revolved around accusations that Akhter participated in actions that posed a threat to the state’s security. These allegations included her alleged association with multiple militant groups, assisting terrorists logistically, and playing a role in subversive undertakings.
