A England-based businessman is suing Apple after his wife discovered messages on his phone to sex workers that he believed he had deleted, The Times reported. He claimed that Apple’s lack of transparency about deleted messages led to his wife filing for divorce.

The husband, an unnamed middle-aged man from England, had his messages to prostitutes found by his wife on the family’s iMac computer.

“If you are told a message is deleted, you are entitled to believe it’s deleted,” he told The Times. “I think if I had been able to discuss it with her rationally and she hadn’t discovered it so abruptly, I might still be married.”

He is seeking over $5 million in damages from Apple for the financial losses incurred from his divorce and legal expenses.

His law firm stated, “Apple has not been clear with users about what happens to messages they send, receive, and delete.”
