VP Dhankhar criticises SC’s use of Article 142, calls it ‘nuclear missile against democracy’

Article 142 empowers the Supreme Court to pass any order necessary to do “complete justice” in any case before it.

New Delhi: Vice President of India Jagdeep Dhankhar has raised serious concerns over the judiciary’s expanding interpretation of Article 142 of the Constitution, stating that the Supreme Court’s special powers under the provision are now being used as a “nuclear missile against democratic forces, 24×7.”

“We cannot have a situation where you direct the President of India,” Dhankhar said, highlighting what he views as judicial overreach into the domains of the executive and legislature.

Article 142 empowers the Supreme Court to pass any order necessary to do “complete justice” in any case before it. However, Dhankhar cautioned that this extraordinary power must not disrupt the balance of the Constitution or override the separation of powers.

He reiterated that constitutional evolution must happen through Parliament, not through judicial activism. “The Constitution has to evolve through the Parliament, not the executive or judiciary,” he had said in earlier statements, reinforcing his view that institutional boundaries must be respected.
