Srinagar: A court here has ordered the arrest of Jitendra Narayan Tyagi alias Waseem Rizvi in connection with a case for his alleged statement against a particular religion.
The directions by the court of Second Additional Munsiff, Judicial Magistrate 1st Class Srinagar, Ahtzaz Ahmed, followed submissions by advocate Amir Masoodi, the counsel for the complainant, that despite several processes, the accused has not appeared before the court.
Advocate Amir submitted that the complainant is aggrieved that the complaint was presented before the Court on 15 December 2021 and till date the accused has not been produced by the warrant executing agency.
“A bare perusal of the case record would reveal that this court had proceeded against the accused and issued a process on 09.02.2022 for offences punishable under sections 153A, 295A, 505 of the Indian Penal Code, 1860,” the court said, adding, “As of yet, the accused has not been produced before the Court. Therefore, the grievance of the complainant seems to be bona fide.”
Keeping in view the submissions and the material placed on the record, the court ordered that SSP concerned of the area where Tyagi resides to arrest him and produce the accused in proper custody before the court on next date of hearing, advocate Amir said.
The court also ordered issuance of non-bailable warrant against Tyagi to be “routed through proper channel and SSP Srinagar is directed to provide all necessary assistance so that the warrant can be forwarded and executed.”
Former UP Shia Waqf Board chairman, Tyagi, converted to Hinduism in 2021. The complaint has been filed by one Danish Hassan Dar, a resident of Srinagar. He has submitted that Tyagi “outraged, attacked and tarnished his religious feelings” by his statement in Lucknow, Uttar Pradesh made on 6 December 2021 that “Islam was a group or organization and that the Holy Book of Muslims Quran is a false and frivolous literature which has no basis at all.” (GNS)
