Madras HC denies anticipatory bail to man accused of sharing post against Prophet Muhammad (ﷺ)on FB

Chennai: The Madras High Court has denied an anticipatory bail request from R Murugesan, a 48-year-old from Coimbatore, who was charged under the Bharathiya Nyaya Sanhita (BNS) and the Information Technology Act, 2000 for posting a blasphemous message about Prophet Muhammad (ﷺ) on Facebook.

Justice P Dhanabal dismissed Murugesan’s plea, which had previously been rejected by the Coimbatore Principal and District Sessions Court on August 8, 2024, as reported by IANS.

The court upheld the argument presented by the government pleader, S Santhosh, who stated that people cannot evade prosecution by claiming they merely shared someone else’s message by mistake or deleted it afterward.

Santhosh referred to a 2023 ruling by Justice N Anand Venkatesh, which stressed upon that those sharing messages on social media must exercise caution and cannot avoid legal consequences for any harm caused before removing the post.
