‘Contrary to Reorganisation Act’: LG Sinha returns CM Omar-led JK cabinet’s business rules file

New Delhi: JK LG Manoj Sinha has returned the file on the proposed Transaction of Business Rules (TBR), sent by the Omar Abdullah-led government in March, seeking clarification on whether proper procedures were followed.

Sources told Times of India that the LG’s office found the rules inconsistent with the J&K Reorganisation Act, particularly over provisions requiring cabinet approval for IAS postings, which fall under the LG’s discretion as per Section 53 of the Act. Officials noted the TBR wrongly assume powers reserved for full statehood.

Drafted by a committee led by senior lawyer Rohinton Nariman, the TBR aim to streamline the functioning of the secretariat and other departments.

The Omar’s government as raised concerns over key IAS appointments replacing JKAS officers, recently transferring 96 JKAS officers on April 29.
