Srinagar: Senior Advocate Nazir Ahmad Ronga has been in detention for almost six months under the Jammu and Kashmir Public Safety Act (PSA), with no official explanation from authorities, his son Advocate Umair Ronga, claimed.
Umair expressed concern over the lack of transparency and delays in legal proceedings, calling the situation disheartening and unjust.
“My father Adv @NazirRonga is on the verge of completing six months in detention, yet there has been no official statement from the police, leaving us in the dark about the true reasons for his confinement. To make matters worse, in the last three hearings the Hon’ble court has been waiting for a senior lawyer to appear on behalf of the state, but his presence remains elusive. This prolonged uncertainty is both disheartening and unjust,” Umair wrote on X.
The absence of a senior state representative in court has further exacerbated the family’s concerns, raising questions about the due process in the case.
Last month, Jammu Kashmir and Ladakh High Court directed the JK government to file a response to incarcerated Advocate Nazir Ahmad Ronga’s habeas corpus petition by December 6.
The case was listed for hearing in the court of Justice Puneet Gupta while no response was yet again filed by the respondents.
The court observed that consequent to numerous opportunities granted to the state, and their failure to file a response to habeas corpus petition, the matter has been listed for final hearing on 16 December next month and the State is granted a final two-week period to file the same, failing which their right shall stand closed.
The petitioner was represented by the senior Supreme Court lawyer D.N. Goburdhun along with Advocate Umair Ronga, Advocate Musharaf Waheed and Advocate Tuba Manzoor.
Notably, the ad hoc chairman of the J&K High Court Bar Association (JKHCBA), Kashmir, Nazir Ahmad Ronga, was arrested in July this year by the LG administration in Srinagar just hours after the Bar issued a notification related to the internal election.
