Jammu: The Jammu and Kashmir Legislative Assembly Secretariat has rejected resolutions on topics such as Article 370, detainees, and reservation policy.
According to sources, these resolutions were disallowed under the Rules of Procedure and Conduct of Business in the J&K Legislative Assembly. Specifically, resolutions on Article 370 were barred under Rule 187, which states that once a resolution has been moved, a similar resolution or amendment cannot be introduced for one year.
Earlier, PC President Sajad Gani Lone had submitted a resolution seeking the restoration of Article 370 and Article 35A.
Additionally, resolutions related to the Home Department were rejected because they fall outside the jurisdiction of the J&K Assembly under Section 32 of the J&K Reorganisation Act. Matters concerning detainees were also disallowed for the same reason, as they come under the Home Department’s domain.
Resolutions concerning reservation and related issues, proposed by both ruling and opposition legislators, were rejected as the matter is currently sub judice in the J&K High Court. Under Sub-Rule (5) of Rule 177, resolutions cannot address matters under judicial review. However, this restriction does not apply to bills brought on reservation issues.
The resolutions that have been admitted will now undergo a ballot procedure on March 25 to determine their order of discussion in the Assembly. Seven resolutions each will be taken up on April 7 and 9. (KNO)
