After a year in jail, GoI agrees to ‘immediately’ release Mian Qayoom

Srinagar: The Government of India has been told by the Supreme Court to release Mian Abdul Qayoom, the advocate and President of Jammu and Kashmir High Court Bar Association, immediately.

According to a report by LiveLaw, based on this submission by Solicitor General Tushar Mehta, who appeared for the Government of India, the court allowed his release, subject to the condition that Qayoom will remain in Delhi and not go to Kashmir till August 7 and that he will also not issue any public statements till then.

Earlier on July 25, Centre had informed SC that Qayoom’s detention order will not be extended beyond August 6, 2020, the date of its expiry

The submission was made in the plea filed on behalf of Qayoom, challenging the 28th May, 2020, Order of the J&K High Court which had dismissed his habeas corpus petition and upheld his detention under the J&K Public Safety Act, 1978.

A three-Judge Bench headed by Justice Sanjay Kishan Kaul heard the matter and directed Solicitor-General Tushar Mehta to seek instructions on whether the Government was willing to release the Petitioner immediately on conditional bail till 6th August 2020, post which the detention order would expire.

Qayoom was detained on August 5, last year when GoI announced the abrogation of Article 370 and bifurcated the erstwhile state of Jammu and Kashmir into two Union Territories J&K, and LAdakh, and has since remained under detention.

The 76-year-old was later shifted to a jail in Agra and then brought to Delhi’s Tihar, where his health deteriorated.
